The AFSS (Annual Fire Safety Statement) is a crucial document that confirms every fire protection measure on the premises has been thoroughly inspected and continues to operate as originally designed and installed. While inspection and testing are integral to this verification, they don’t entirely fulfill the requirements. Especially since 2020, the EP&A regulation mandates the involvement of an accredited Competent Fire Safety Practitioner (CFSP) to endorse and validate each of the measures on your property. Understanding Fire Safety Assessment
Responsibility for Assessment
As of 1st July 2020, the NSW Environmental Planning and Assessment Regulation 2000 mandates that building owners ensure all fire safety measures undergo assessment and endorsement by an Accredited Practitioner Fire Safety. Post-assessment, the Annual Fire Safety Statement (AFSS) or Fire Safety Certificate must be submitted to both the Council and the NSW Fire & Rescue. Additionally, a copy should be prominently displayed within the building.
Who Issues Certificates and Statements?
While the Fire Safety Certificate and Annual Fire Safety Statement are endorsed by an Accredited Practitioner Fire Safety, the final sign-off is the responsibility of the building owner or their designated agent.
Annual Fire Safety Statement (AFSS) Timeline
An AFSS must be submitted annually, starting from the date the initial Fire Safety Certificate was acquired. If an AFSS hasn’t been submitted to the Council within the past 12 months, it’s considered overdue, necessitating immediate submission to avoid potential fines or legal repercussions.

Before any new construction or significant building alteration, a Fire Safety Certificate is essential. This certificate enumerates all fire safety measures associated with the property. After a registered fire safety professional reviews it, the document is then forwarded to the local council for approval.

An FSS is a comprehensive list detailing all necessary fire protection systems and equipment for a property, along with the standards each measure must meet. This schedule specifies the Building codes, Australian Standards, or other pertinent requirements for compliance.
Annual Fire Safety Statement Explained
The AFSS mandates that an accredited individual assesses, tests, and services every item listed on your FSS. Council inspections can lead to an FSS issuance, and if they retain the relevant data, they can provide an FSS upon request.
